The following terminology applies to these Terms and Conditions, Privacy Statement and Disclaimer Notice and all Agreements: "Client", "You" and "Your" refers to you, the person log on this website and compliant to the Company’s terms and conditions. "The Company", "Ourselves", "We", "Our" and "Us", refers to our Company. "Party", "Parties", or "Us", refers to both the Client and ourselves. All terms refer to the offer, acceptance and consideration of payment necessary to undertake the process of our assistance to the Client in the most appropriate manner for the express purpose of meeting the Client’s needs in respect of provision of the Company’s stated services, in accordance with and subject to, prevailing law of India. Any use of the above terminology or other words in the singular, plural, capitalization and/or he/she or they, are taken as interchangeable and therefore as referring to same.

YMGrad does not filter, edit, publish or review Comments prior to their presence on the website. Comments do not reflect the views and opinions of YMGrad,its agents and/or affiliates. Comments reflect the views and opinions of the person who post their views and opinions. To the extent permitted by applicable laws, YMGrad shall not be liable for the Comments or for any liability, damages or expenses caused and/or suffered as a result of any use of and/or posting of and/or appearance of the Comments on this website.

YMGrad reserves the right to monitor all Comments and to remove any Comments which can be considered inappropriate, offensive or causes breach of these Terms and Conditions.

You hereby grant YMGrad permission to send you updates and offers in the form of emails.

The following organizations may link to our Website without prior written approval:

• Government agencies;

• Online directory distributors may link to our Website in the same manner as they hyperlink to the Websites of other listed businesses; and

These organizations may link to our home page so long as the link: (a) is not in any way deceptive; (b) does not falsely imply sponsorship, endorsement or approval of the linking party and its products or services; and (c) fits within the context of the linking party’s site.

If you are one of the organizations listed in paragraph 2 above and are interested in linking to our website, you must inform us by sending an e-mail to YMGrad. Please include your name, your organization name, contact information as well as the URL of your site, a list of any URLs from which you intend to link to our Website, and a list of the URLs on our site to which you would like to link. Wait 2-3 weeks for a response.

Approved organizations may hyperlink to our Website as follows:

• By use of our corporate name; or
• By use of the uniform resource locator being linked to; or
• By use of any other description of our Website being linked to that makes sense within the context and format of content on the linking party’s site.

No use of YMGrad's logo or other artwork will be allowed for linking absent a trademark license agreement.

Without prior approval and written permission, you may not create frames around our Webpages that alter in any way the visual presentation or appearance of our Website.

Content Liability

We shall not be hold responsible for any content that appears on your Website. You agree to protect and defend us against all claims that is rising on your Website. No link(s) should appear on any Website that may be interpreted as libelous, obscene or criminal, or which infringes, otherwise violates, or advocates the infringement or other violation of, any third party rights.

Reservation of Rights

We reserve the right to request that you remove all links or any particular link to our Website. You approve to immediately remove all links to our Website upon request. We also reserve the right to amen these terms and conditions and it’s linking policy at any time. By continuously linking to our Website, you agree to be bound to and follow these linking terms and conditions.

Removal of links from our website

If you find any link on our Website that is offensive for any reason, you are free to contact and inform us any moment. We will consider requests to remove links but we are not obligated to or so or to respond to you directly.

We do not ensure that the information on this website is correct, we do not warrant its completeness or accuracy; nor do we promise to ensure that the website remains available or that the material on the website is kept up to date.

Objectionable Content

Cancellation and Refund Policy

Certain refund requests for services may be considered by YMGrad on a case-by-case basis and granted in sole discretion of YMGrad. These are offered where YMGrad is no longer able to offer you a service due to constraints solely on YMGrad's end.

Disclaimer

For the complete application help service, if payments are made in two parts and the parts are distributed in a time frame of over 48 hours, a 5% premium shall be charged on the entire service charge.

Certain refund requests for services may be considered by YMGrad on a case-by-case basis and granted in sole discretion of YMGrad. These are offered where YMGrad is no longer able to offer you a service due to constraints solely on YMGrad's end.

A change of mind or any change in circumstances not controlled by YMGrad would not entitle the user to a refund.

Any funds added due to an incorrect purchase which was not intentional would be eligible for a refund to the YMGrad wallet only.

For the complete application help, if payment in two parts is made, the second half of the services will only be activated with the second part of the payment. If no payment for the second part is made, the service will be terminated at the end of one year.

For the complete application help service, the application help only includes answers to video scripts or other questions on the application portal that may be answered under 250 words. All other essays are separately chargeable.

For the SOP, the word limits imposed by universities are usually from 500 words to 1000 words. In general, it is advisable to keep them as concise as possible to showcase that you are competent enough to describe your goals in the shortest possible essay. However, YMGrad is liberally setting its word limits per SOP draft to 1200 words per draft for your convenience, should there be a requirement on your end. Any word counts requested beyond this mark is separately chargeable.

Application portal help and scholarship application support in the Complete Application Help package is only given for the universities that you use the customizations/SOP for.

Change of program is not supported in customizations as the complete perspective of the draft would change. It is recommended to get a separate SOP for a different program. Customizations only cover change of professor, word limits, and the university. The first draft is altered for the same and incorporates alterations of up to 250 words.

We prefer facilitating changes that you may ask for in your drafts to the best of our ability. Hence, we do not put a limit on the changes you may ask for. However, this is keeping in mind that the initial inputs cannot be changed after the output is produces. Misuse of services, if detected, will result in termination of the services with a forfeiture of the funds.

All services must be used within one year of your purchase, after which they will be terminated automatically. To avoid the termination, you must connect with us in advance and extend your services.

Enrolling into the scholarship application help services does not guarantee a scholarship. It only entails support for your applications. Whether the scholarship is disbursed in your favor is not controlled by YMGrad and no refunds are offered in the case of such scholarship being denied to the user.

The time required for each service begins after you submit the inputs and excludes non-working days. Also, in case you edit the inputs, the time required is reset.

There are two pipelines: Normal (2-2.5 weeks) and Lightning speed (48-72 hours). It is fully the client's responsibility to avail the service as per the timelines. If the timeline is not working for the client, they are welcome to connect with the team in advance and upgrade to lightning speed.

In case you are allotted a point of contact you are in touch with over email or messaging, please understand that the consultant is only obligated to respond to your queries during our working hours (Monday to Friday, 9:30 A.M. to 5 P.M.).

The organization may not allow unlimited modifications of the drafts. One finalized modification is allowed for each draft that we write for you. Please include all your changes/suggestions/questions (if any) in your review.

Any service you enroll into on the website must be exhausted within one full year of your purchase, failing which, the service will automatically expire.

In all other cases, the expiry of services occurs at the exhaustion of a service or at the end of one year of purchase, whichever occurs earlier.

Once a service is exhausted or expired, it cannot be reused again without a new purchase for the same.

In exceptional cases where the service is unused and at the sole discretion of YMGrad, certain services may be renewable on a case-by-case basis in the next 6 months of expiry only. A renewal fee will apply in such cases.

The organisation reserves the rights to dismiss your account at any time in case misuse of the services is detected.

The services like Profile Evaluation and University Shortlisting, TOEFL Consultation, and GRE Consultation are single delivery services which may not include updating the preparation schedule or list of universities.

Enrolling in the Visa application help does not guarantee a visa and no refunds are offered on the basis of slot booking, account blocks, or visa denials. YMGrad does offer support in limited capacity in the case of a visa rejection. Opening the CGIFederal account after enrolling is prohibited as our agents are constantly trying to book a slot for you. Booking your own slot yourself or via an external agent would not entitle the user to a refund. We do not have any separate charges or service for slot booking alone.

Enrolling in the Express Entry/PNP help or Job application help does not guarantee a job offer within a specific period and no refunds are offered on the basis of a job offer not being generated within a specified period, interview set ups, or interview rejections. Extra charges may apply in case training of the applicant is needed. The Job Application Help targets 25 job applications in the first two months of service enrolment. In the subsequent two months (which are to be treated as a cool-off period), if the employer responses are negative or non-existent, we will target an additional 25 applications starting from the fourth month.

For visa application help clients, it is fully your responsibility to keep the credentials up to date on the inputs page on YMGrad. Adding incorrect credentials will cause disregard of your account from monitoring and YMGrad will not be responsible for any missed slots due to this reason.

Visa application help can be switched to a different country (B) only as long as any part of the process has not been done for country (A). Once the processing is started and any component of the visa service is rendered for country A, you may not change the service to country B without a new purchase.

Any contact with your point of contact should be done during working hours. We strongly discourage personal messaging your point of contact outside working hours. Such activities may cause trouble to your agent and should only be done in extremely urgent scenarios. Repeated contact outside working hours may lead to removal of the point of contact from your account. No replacement will be provided.

YMGrad WhatsApp support is offered for select services and is only offered to the registered mobile number on the website. Multiple numbers are not supported under any circumstances for purchases from a single account.

YMGrad WhatsApp support may be revoked in case of misbehaviour with any of our executives. It will not be reinstated once revoked.

Any kind of misbehaviour or harassment with your point of contact will be treated with utmost severity and will result in termination of your services. In such cases, all fees are forfeited.

The 100% admissions guarantee with the complete application help is subject to the following terms:

• The applicant applies to all the universities with YMGrad that are shortlisted for their profile.
• There are at least 2 of each kind: Ambitious, Moderate, and Safe universities.
• The applicant gets rejects from all the universities (which are to be forwarded to YMGrad over email).

To the maximum extent permitted by applicable law, we exclude all representations, warranties and conditions relating to our website and the use of this website. Nothing in this disclaimer will:

• limit or exclude our or your liability for death or personal injury;
• limit or exclude our or your liability for fraud or fraudulent misrepresentation;
• limit any of our or your liabilities in any way that is not permitted under applicable law; or
• exclude any of our or your liabilities that may not be excluded under applicable law.

The limitations and prohibitions of liability set in this Section and elsewhere in this disclaimer: (a) are subject to the preceding paragraph; and (b) govern all liabilities arising under the disclaimer, including liabilities arising in contract, in tort and for breach of statutory duty.

We will not be liable for any loss or damage of any nature resulting from the use of the content on the website.

All benefits of the referral programs may be used for any service offered on the services page or the RateMyChances tool. Each referral is capped at INR 2,000 or its equivalent USD value.

YMGrad's Policies and Terms & Conditions may be changed or updated occasionally to meet the requirements and standards. Therefore the Customers’ are encouraged to frequently visit these sections in order to be updated about the changes on the website. Modifications will be effective on the day they are posted.

RateMyChances Disclaimer

• RateMyChances (RMC) uses your YMGrad profile for performing evaluations. Editing your profile and updating information will have an effect on the results.
• We do not store your evaluation results in our database or share them with any third party.
• Because the evaluations are subject to change based on your YMGrad profile, the results will disappear on refreshing pages.
• RMC does not check for the minimum requirements of the universities.
• RMC works on broader granularity such as Engineering, Business, Medicine, and Law.
• RMC has been tested and verified by our admissions experts. In most cases, the results are very accurate. However, the algorithm does not work extremely well for universities where we do not have enough data in our database. These are rare cases.
• While the evaluations are tested, YMGrad does not guarantee admission into SAFE universities or rejection from AMBITIOUS universities. This is primarily because RMC only crunches Quantitative data like your scores, experience, university acceptance rates, etc. However, it does not take into account the non-quantitative data like SOPs, LORs, admission interviews, etc.
• The algorithm is proprietary and gives different weightage to scores and GPA based on your stream. Disclosure of the algorithm is strictly prohibited.
• YMGrad agents do not hold any liability of explaining the results of the RMC algorithm.

Any purchase, dispute, or claim arising out of or in connection with this website shall be governed and construed in accordance with the laws of UAE.
